Prospective Marriage Visa

Prospective Marriage Visas are available to applicants who would like to enter Australia for the purpose of marrying an Australian partner.  Please note that these visas are not available to same sex couples as gay marriages are not formally recognized under Australian law.

To be eligible for this visa, the applicant must be:

Of a legal age to marry in Australia;

Able to prove that they have physically met the Australian partner in person;

Sponsored by the Australian partner;

Outside of Australia when the application is lodged and decided;

Married to their Australian partner within 9 months of having arrived in Australia..

After the applicant has married their Australian partner, the applicant may then apply for a provisional spouse visa provided they are able to demonstrate that the relationship is still genuine and continuing.

More detailed information regarding these visas can be obtained through the Australian Migration Advisory.
