Migration Agents Operating Outside of Australia

Due to the extensive and complex nature of international law, Australia is unable to enforce regulatory measures upon persons or agencies offering Australian immigration advice outside of Australia. This means that Australia is unable to exercise its powers in ensuring that offshore Agents adhere to the Code of Conduct, thereby avoiding sanction or disciplinary measures for misleading advice and unethical practices.

As such, the Australian Migration Advisory recommends that you adhere to the following safety measures before appointing legal representation overseas:

Check to make sure that the Agent is registered with the Migration Agents Registration Authority;

Insist that the Agent show you a copy of their current migration licence so that you can confirm their identity and Migration Agent Registration Number (the licence should include photo identification);

Visit https://www.mara.gov.au and check the Agent's details by confirming their identity against the MARN;

Check to make sure that the Agent does not have any sanctions or disciplinary actions recorded against their name.
