Solicitors and lawyers operating inside and outside of Australia |
Australian immigration law is complex by nature and requires an experienced person to navigate through legislation and policies which govern migration practices in Australia. Unlike Registered Migration Agents, lawyers do not have to show proficiency in immigration law in order to practice in Australia. |
Unfortunately, this allows lawyers to represent immigration cases without ever having studied or practiced immigration law. As such, the Australian Migration Advisory suggests the following safety measures when appointing lawyers to represent you in relation to an immigration matter: |

Make sure that the lawyer actually specialises in Australian Immigration Law; |

Ask the lawyer if they attend Continuing Professional Development seminars. It is important that persons working within the immigration industry remain up-to-date given the large number of changes made to legislation and policy each year; |

Lawyers are not obliged to uphold the Code of Conduct and therefore you may want them to agree to do so in writing before you proceed; |
 |
Lawyers often charge high hourly rates and therefore you may wish to ask them for a fixed quote before proceeding. |
